PUBLIC NOTICE

I, Mrs. Sarayu, wife of Mr. Ramamurthy, residing at Plot Nos. 87 and 88, Sun Garden, Morattandi Village, Vanur Taluk, Villupuram District, Tamil Nadu – 605 101, hereby issue this Public Notice as follows:

I am a partner of M/s. Kristal Foods, a partnership firm bearing Registration No. 533/2016, carrying on business at R.S. Nos. 18/6 and 18/7, 7th Cross, PIPDIC Industrial Estate, Sedarapet, Puducherry – 605 111.

I hereby notify the public that disputes and differences have arisen and are presently subsisting between myself and the other partner of the firm, Mrs. Jayanthi, wife of Mr. Shankar, in relation to the affairs, management and assets of the said partnership firm.

In the circumstances, members of the public, purchasers, dealers, agents, financiers, intermediaries and all other persons are hereby cautioned not to purchase, acquire, receive, take delivery of, transfer, remove, encumber, deal with or otherwise enter into any transaction whatsoever in respect of any goods, stock-in-trade, plant, machinery, equipment, fixtures, fittings, materials or any other movable or immovable assets belonging to M/s. Kristal Foods, with Mrs. Jayanthi, any person claiming to be authorised by her, or any other person claiming to act for or on behalf of the firm, without my prior written consent.

All such assets are assets of the partnership firm and Mrs. Jayanthi does not have any exclusive or absolute right, title or ownership over the same so as to deal with, transfer or dispose of them unilaterally to the exclusion of my rights and interest as a partner of the firm.

Any person entering into any transaction concerning the aforesaid assets, despite this Public Notice and without my prior written consent, shall do so at his/her/their own risk, responsibility and consequences. Any such purported transaction shall be void, disputed and challenged by myself in accordance with law and shall not, insofar as legally permissible, prejudice, defeat or bind my rights and interest in the partnership firm or its assets.

I expressly reserve my right to initiate all appropriate civil and criminal proceedings and to seek injunctions, recovery, restoration, damages, compensation and all other remedies available to myself under law against any person who unlawfully deals with, removes, transfers, alienates, encumbers or otherwise interferes with the assets of the partnership firm or acts in derogation of my lawful rights and interest therein.

The public is therefore requested to take due notice of the above and act accordingly.

This Public Notice is issued in both English and Tamil. In the event of any discrepancy, inconsistency or difference in interpretation between the English and Tamil versions, the English version shall prevail and be valid.

தமிழ்நாடு – 605 101, விழுப்புரம் மாவட்டம், வானூர் வட்டம், மொரட்டாண்டி கிராமம், சன் கார்டன், மனை எண்கள் 87 மற்றும் 88-ல் வசிக்கும் திரு. ராமமூர்த்தி அவர்களின் மனைவி திருமதி சரயு ஆகிய நான், பொதுமக்களுக்கு இதன்மூலம் பின்வருமாறு அறிவிக்கிறேன்:

புதுச்சேரி – 605 111, சேதராப்பட்டு, PIPDIC தொழிற்பேட்டை, 7-வது குறுக்குத் தெரு, R.S. எண்கள் 18/6 மற்றும் 18/7 என்ற முகவரியில் தொழில் நடத்தி வரும், பதிவு எண் 533/2016 கொண்ட M/s. கிறிஸ்டல் ஃபுட்ஸ் (Kristal Foods) என்ற கூட்டாண்மை நிறுவனத்தின் கூட்டாளியாக நான் இருந்து வருகிறேன்.

மேற்படி கூட்டாண்மை நிறுவனத்தின் மற்றொரு கூட்டாளியான திருமதி ஜெயந்தி, கணவர் பெயர் திரு. சங்கர் அவர்களுக்கும் எனக்கும், நிறுவனத்தின் நிர்வாகம், செயல்பாடுகள் மற்றும் சொத்துகள் தொடர்பாக பிணக்குகளும் கருத்து வேறுபாடுகளும் ஏற்பட்டுள்ளன; அவை தற்போது நிலுவையில் உள்ளன என்பதை இதன்மூலம் பொதுமக்களுக்கு அறிவிக்கிறேன்.

எனவே, எனது முன் எழுத்துப்பூர்வமான ஒப்புதல் இன்றி, M/s. கிறிஸ்டல் ஃபுட்ஸ் (Kristal Foods) கூட்டாண்மை நிறுவனத்திற்குச் சொந்தமான பொருட்கள், வணிகச் சரக்குகள், கையிருப்புப் பொருட்கள், ஆலை, இயந்திரங்கள், உபகரணங்கள், பொருத்துதல்கள், தளவாடங்கள் அல்லது பிற அசையும் மற்றும் அசையாச் சொத்துகள் எதனையும், திருமதி ஜெயந்தி அவர்களிடமோ, அவரால் அதிகாரம் அளிக்கப்பட்டதாகக் கூறும் நபரிடமோ அல்லது நிறுவனத்தின் சார்பில் செயல்படுவதாகக் கூறும் வேறு எவரிடமோ வாங்கவோ, பெறவோ, கையகப்படுத்தவோ, மாற்றம் செய்யவோ, எடுத்துச் செல்லவோ, அடமானம் அல்லது பிற வில்லங்கம் ஏற்படுத்தவோ அல்லது அவை தொடர்பாக எந்தவிதமான பரிவர்த்தனையிலும் ஈடுபடவோ வேண்டாம் என்று பொதுமக்கள், வியாபாரிகள், வாங்குபவர்கள், முகவர்கள், நிதி நிறுவனங்கள், இடைத்தரகர்கள் மற்றும் தொடர்புடைய அனைவரும் இதன்மூலம் எச்சரிக்கப்படுகிறார்கள்.

மேற்கூறிய அனைத்து சொத்துகளும் M/s. கிறிஸ்டல் ஃபுட்ஸ் (Kristal Foods) கூட்டாண்மை நிறுவனத்திற்குச் சொந்தமான நிறுவனச் சொத்துகளாகும். அவற்றின் மீது திருமதி ஜெயந்தி அவர்களுக்கு மட்டும் தனிப்பட்ட, முழுமையான அல்லது பிரத்தியேகமான உரிமையோ சொத்துரிமையோ கிடையாது. எனவே, கூட்டாளியான எனது உரிமை மற்றும் பங்கினைப் புறக்கணித்து, மேற்கண்ட சொத்துகளை அவர் ஒருதலைப்பட்சமாக விற்பனை செய்யவோ, மாற்றம் செய்யவோ அல்லது வேறு விதமாக அப்புறப்படுத்தவோ உரிமையில்லை.

மேற்கூறிய இந்தப் பொது அறிவிப்பை மீறியும், எனது முன் எழுத்துப்பூர்வமான ஒப்புதல் இன்றியும், மேற்கூறிய சொத்துகள் தொடர்பாக எவரேனும் எந்தவொரு பரிவர்த்தனையிலும் ஈடுபட்டால், அத்தகைய பரிவர்த்தனை அவரவர் சொந்த அபாயம், பொறுப்பு மற்றும் அதன் விளைவுகளுக்குட்பட்டதாகவே இருக்கும்.

அவ்வாறு மேற்கொள்ளப்படும் எந்தவொரு பரிவர்த்தனையும் செல்லாததாகக் கருதப்பட்டு, என்னால் மறுக்கப்பட்டு, சட்டப்படி உரிய முறையில் சவாலுக்கு உட்படுத்தப்படும். மேலும், சட்டப்படி அனுமதிக்கப்படும் வரையில், அத்தகைய பரிவர்த்தனை கூட்டாண்மை நிறுவனத்திலும் அதன் சொத்துகளிலும் எனக்குள்ள உரிமை, பங்கு அல்லது நலன்களை எந்தவிதத்திலும் பாதிக்கவோ, குறைக்கவோ, தோற்கடிக்கவோ அல்லது என்னைக் கட்டுப்படுத்தவோ இயலாது.

கூட்டாண்மை நிறுவனத்தின் சொத்துகளை சட்டவிரோதமாக விற்பனை செய்வோர், மாற்றம் செய்வோர், எடுத்துச் செல்வோர், வில்லங்கம் ஏற்படுத்துவோர், கையகப்படுத்துவோர் அல்லது அவற்றில் எனக்குள்ள சட்டபூர்வ உரிமை மற்றும் நலன்களுக்கு எதிராகச் செயல்படுவோர் எவராக இருந்தாலும், அவர்களுக்கு எதிராக தடை உத்தரவு, சொத்து மீட்பு, மீள ஒப்படைப்பு, நஷ்டஈடு மற்றும் சட்டப்படி கிடைக்கக்கூடிய பிற நிவாரணங்கள் கோரி உரிய சிவில் மற்றும் குற்றவியல் சட்ட நடவடிக்கைகளை மேற்கொள்ளும் எனது அனைத்து உரிமைகளையும் நான் வெளிப்படையாக ஒதுக்கி வைத்துள்ளேன்.

எனவே, மேற்கண்ட விவரங்களை பொதுமக்கள் அனைவரும் கவனத்தில் கொண்டு அதற்கேற்ப செயல்படுமாறு கேட்டுக்கொள்கிறேன்.

இந்தப் பொது அறிவிப்பு ஆங்கிலம் மற்றும் தமிழ் ஆகிய இரு மொழிகளில் வெளியிடப்பட்டுள்ளது. ஆங்கிலம் மற்றும் தமிழ் பதிப்புகளுக்கு இடையே ஏதேனும் முரண்பாடு, முரண் அல்லது பொருள் விளக்க வேறுபாடு இருந்தால், ஆங்கிலப் பதிப்பே செல்லுபடியாகும்.
